Prove That You’ve Been Separated For 12 Months

In Australia, you are required to have separated from your partner for a minimum of 12 months before you file for divorce. It is possible to be separated but still living in the same house.

Find Your Marriage Certificate

You’ll need to find proof of marriage, usually in the form of a marriage certificate. If the certificate is not in English, you’ll need to get it translated.

File And Submit Your Online Application

You’re able to complete an application online through an easy-to-use comcourts portal. Once you have answered all the questions and filled in all fields, you can submit your application.

Serve Your Ex-Partner

Once you have completed your online application, you’ll have to serve your ex-partner at least 28 days before the hearing. If they do not live in the country, you’ll have to give them at least 42 days’ notice.

Check To See If You Have To Go To Court

If the application is a sole application and you have children under 18 years old, you’ll need to attend court. There are many instances in which you won’t have to go to court, so be sure to check.
